Welcome to the digital wellness platforms operated by Healthtek Inc. (referred to in these Terms as “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your use of our apps, websites, services, and any related content or features (collectively, the “Service”). By creating an account or using our Service, you agree to these Terms and our Privacy Policy, which you were presented with prior to using the Service and which includes information about how we use cookies and similar technologies for essential functionality and analytics.
- Eligibility and Acceptance
By accessing or using the Service, you confirm that:
- You must be at least 16 years old to use our services, unless a different minimum age is specified for a particular service or required by the laws of your region, or you have the consent of a parent or legal guardian.
- If you are a resident of Texas, you must be at least 18 years old or have verified parental or legal guardian consent as required by Texas law.
- Our anonymous PeerSupport service may be used by individuals 13 years of age or older, subject to any parental or guardian consent requirements that apply in your jurisdiction.

If you are using the Service on behalf of someone else, you have their permission to do so.
If you do not agree to these Terms, you must not use the Service.
- Description of Service
The Service allows users to join wellness challenges, track progress using integrated data from supported health tracking platforms (e.g., Apple Health, Google Fit), and view leaderboards. The Service is intended for informational and motivational purposes and is not a medical or therapeutic tool.
We reserve the right to modify, suspend, or discontinue any feature of the Service at our discretion.
- User Accounts and Security
To access certain features, you may need to register an account. You agree to:
- Provide accurate and up-to-date information.
- Keep your login credentials secure.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to disable or terminate accounts that violate these Terms.
- Data Use and Privacy
We explain our data practices in our Privacy Policy, which includes what personal data we collect, how we use it, and the choices you have. By using the Service, you consent to the collection and use of your personal and activity-related data solely for the operation of the Service and its intended functionality.
We do not sell your personal information.
- License and Acceptable Use

- Health and Wellness Disclaimer
The Service is designed for general wellness purposes and is not a substitute for medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider before making any health-related decisions or starting a new wellness program.
We do not guarantee any health or fitness outcomes from using the Service and are not responsible for any physical or mental health consequences.
- User Conduct and Content
When using features that allow you to submit content (e.g., messages, usernames, challenge names), you agree to use them responsibly and not submit content that is:
- Offensive, defamatory, or discriminatory
- False or misleading
- Infringing on intellectual property rights
- Commercial, promotional, or spam
- Harmful to the system or other users
We may remove content and/or suspend access if you violate this section. We use human review to moderate activity and content.
If you are unhappy about any of our content moderation decisions, you can submit a complaint by email using the details in section 15 below.
Non-personal content you submit may be used by us for Service improvement or marketing, unless you request otherwise.
- Intellectual Property
We retain ownership of all intellectual property rights in the Service and its content, excluding third-party integrations and user-submitted content. You may not use our branding without written permission.
- Third-Party Integrations
The Service may link to or integrate with third-party platforms (e.g., Apple Health, Google Fit). These integrations are governed by their own terms and privacy policies.
We do not control or endorse third-party data sources and are not responsible for their accuracy or availability.
- Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee uninterrupted or error-free operation, nor the accuracy of any performance data.
To the fullest extent permitted by law, we disclaim liability for any indirect, incidental, or consequential damages. Nothing in these Terms excludes liability for gross negligence, fraud, or any liability that cannot be excluded under applicable law.
- Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any reason at our discretion. Upon termination, your license to use the Service ends immediately.
